Article 2 Purpose and scope
These Terms and Conditions of Sale, hereinafter referred to as the “Terms”, define the respective rights and obligations of Voyager Mieux and the Client in relation to:
- personalised travel-planning services;
- travel consulting and Travel Planner services;
- itinerary review and analysis services;
- personalised consultations and support;
- the sale of presets, ebooks, guides and digital content;

These Terms apply to orders concluded through the website, by email, by quotation, after completion of a questionnaire, following a call, or by any other means of distance communication.
The essential characteristics, price, content, delivery period and any specific conditions applying to each offer are stated on its sales page, in the quotation or in the order confirmation.
Any specific conditions contained in an accepted quotation or offer shall take precedence over these Terms where they concern a specific aspect of the order.
By placing an order, the Client confirms that they have read and accepted these Terms before becoming definitively bound.
The applicable Terms are those in force on the date of the order.
Article 3 Services and products offered
3.1. Personalised Travel Planner services
Depending on the package selected, the service may include:
- analysis of the Client’s travel project and requirements;
- consideration of the travel dates, budget, preferred pace and personal preferences;
- creation of a personalised day-by-day itinerary;
- research into transport, accommodation and activities;
- selection of restaurants, cafés, attractions and experiences;
- practical and cultural advice;
- creation of a digital travel book or guide;
- creation of a digital map or list of locations;
- provision of booking links;
- follow-up discussions or calls where included in the offer.
Only the elements expressly included in the offer, quotation or order confirmation form part of the service.
3.2. Itinerary review and analysis
This service consists of reviewing an itinerary prepared by the Client and providing comments, corrections, recommendations or suggestions for improvement.
It does not include the complete creation of a new itinerary unless expressly stated otherwise in the offer.
3.3. Consultations and personalised support
Voyager Mieux may offer consultations by telephone or video call, follow-up calls and personalised support.
The duration, content and conditions of each consultation are provided before the order is placed.
3.4. Digital products and content
Voyager Mieux may sell, in particular:
- Lightroom presets and other settings files;
- ebooks and digital guides;
- digital travel books and itineraries;
- templates, lists and practical resources;
- downloadable maps and resources;
- future training courses or digital resources.
3.5. Free introductory call
A free introductory call is a preliminary and non-binding discussion. It does not constitute an order and does not include the full performance of a personalised service.
Article 4 Nature of the Travel Planner service
4.1. Independent consulting service
Voyager Mieux sells an independent intellectual service consisting of research, advice, itinerary design and travel planning.
The price paid to Voyager Mieux exclusively covers its consulting, research, creation and support services.
The Client does not pay Voyager Mieux for flights, trains, accommodation, vehicle rentals, restaurants, visits or tourist activities.
4.2. Bookings made by the Client
The Client makes their own bookings and enters directly into contracts with carriers, hotels, platforms, restaurants, guides, activity providers and other third-party suppliers.
The Client pays these third parties directly and accepts their own terms and conditions of sale or use.
Links provided by Voyager Mieux are intended solely to facilitate the Client’s research. The Client remains free to select, modify or decline any recommendation.
4.3. No sale of third-party travel services
In connection with the services governed by these Terms, Voyager Mieux:
- does not sell transport tickets;
- does not sell hotel nights or accommodation packages;
- does not sell vehicle rentals;
- does not sell package holidays;
- does not collect payment for third-party travel services;
- does not make bookings in the Client’s name;
- does not become a party to contracts concluded between the Client and third-party suppliers;
- does not automatically transfer the Client’s details to a supplier in order to complete a booking on the Client’s behalf.
Voyager Mieux therefore does not act, in this context, as a travel agency, tour organiser or retailer of package holidays.
Article 5 Pre-contractual information
Before becoming bound, the Client receives or is able to access, depending on the ordering method:
- the essential characteristics of the service or product;
- the exact content of the offer;
- the total price and payment terms;
- the date or estimated period of performance or delivery;
- any applicable technical compatibility requirements;
- the complaint procedure;
- information regarding the right of withdrawal;
- these Terms;
- Voyager Mieux’s contact details.
The Client is invited to request any necessary clarification before accepting a quotation or making payment.
The Client is responsible for checking that the selected offer meets their needs and that all information supplied to Voyager Mieux is accurate and complete.
Article 6 Orders by quotation, email or online
6.1. Ordering methods
An order may be concluded:
- by accepting a personalised quotation;
- through an exchange of emails;
- after completion of a questionnaire or following a call;
- through an online payment page or online shop;
- through any other process expressly offered by Voyager Mieux.
6.2. Acceptance of a quotation
The quotation specifies, in particular, its purpose, price, validity period, content, estimated delivery period, payment stages and any applicable specific conditions.
The Client may accept the quotation:
- by signing it;
- by sending an unambiguous written acceptance by email;
- or by making the requested payment after receiving the quotation and these Terms.
A telephone conversation alone does not constitute a final order. The order must be confirmed in writing or on another durable medium.
6.3. Formation of the contract
Unless otherwise specified in the offer, the order becomes final following:
- the Client’s express acceptance of the quotation or offer;
- acceptance of these Terms;
- receipt of full payment or the requested deposit;
- confirmation of the order by Voyager Mieux.
Voyager Mieux sends the Client an order confirmation and the applicable contractual documents by email or another durable medium.
6.4. Orders placed through the website
Where an offer is ordered directly through the website, the Client must review the order summary, correct any errors, accept these Terms and expressly confirm their obligation to pay.
6.5. Refusal of an order
Voyager Mieux may refuse an order for a legitimate reason, including:
- unavailability incompatible with the requested deadline;
- a request that is clearly impossible or unlawful;
- failure to provide essential information;
- a payment issue or suspicion of fraud;
- a request outside Voyager Mieux’s area of expertise;
- abusive, threatening or disrespectful conduct.
Where an order is refused before work begins, any amounts already paid will be refunded, except in cases of fraud, abusive payment reversal or any other lawful reason allowing Voyager Mieux to retain them.
Article 7 Prices and payment
7.1. Prices
The applicable prices are those displayed on the website, quotation, sales page or order summary at the time of purchase.
Prices are stated in euros. Voyager Mieux benefits from the French VAT exemption scheme for small businesses.
The following statement applies: “VAT not applicable pursuant to Article 293 B of the French General Tax Code.”
Prices paid to Voyager Mieux never include sums payable directly by the Client to airlines, hotels, carriers, restaurants, platforms or any other third-party suppliers.
7.2. Payment methods
Payment may be made:
- by bank transfer;
- by bank card where online payment is available;
- by any other method stated in the quotation or order summary.
The bank details required to make a bank transfer are communicated directly to the Client.
A bank transfer is considered received only when the funds have effectively been credited to Voyager Mieux’s bank account.
Any banking fees, currency conversion charges or fees applied by the Client’s bank remain payable by the Client.
7.3. Full payment or deposit
Voyager Mieux may require:
- full payment when the order is placed;
- a deposit followed by payment of the balance;
- a payment schedule expressly stated in the quotation.
Unless stated otherwise in the quotation, any amount expressly described as a “deposit” constitutes a firm partial payment of the price and binds both parties, subject to the Consumer’s statutory right of withdrawal.
The amount of the deposit, payment deadlines and the date on which the balance becomes payable are stated in the quotation or order confirmation.
Voyager Mieux is not required to begin or continue performing the service until all amounts that have become due have been received.
7.4. Failed payments and payment reversals
In the event of a failed, rejected, cancelled or reversed payment, the order may be suspended or cancelled.
An abusive or fraudulent payment reversal does not prevent Voyager Mieux from claiming any outstanding sums and compensation for any loss suffered.
7.5. Invoicing
An invoice is sent to the Client electronically or otherwise provided on a durable medium.
Article 8 Performance of services and delivery
8.1. Commencement of the service
Unless otherwise agreed, work begins after:
- validation of the order;
- receipt of the required payment;
- receipt of the questionnaire and all necessary information;
- expiry of the withdrawal period or the Client’s express request for the service to begin before that period expires.
8.2. Performance period
The applicable period is stated on the sales page, quotation or order confirmation.
Where no period has been stated, the service or product will be supplied without undue delay and no later than the applicable statutory deadline.
Any delivery period expressed in business days excludes Saturdays, Sundays and French public holidays.
8.3. Missing information or late responses
Where the Client delays responding, completing the questionnaire or providing essential information, the announced schedule may be postponed accordingly.
The revised delivery date will depend on Voyager Mieux’s availability when the Client’s file becomes complete.
8.4. Delivery
Services and products are primarily delivered:
- by email;
- through a download link;
- through a customer account;
- as a PDF document or another digital format;
- by video call or telephone call for consultations.
The Client must provide a valid email address, check their spam folder and promptly report any delivery issue.
8.5. Delay by Voyager Mieux
Where a delay is anticipated, Voyager Mieux will inform the Client as soon as reasonably possible and provide a revised estimate.
The Consumer’s statutory rights in the event of delayed performance or delivery remain fully applicable.
Article 9 Client obligations
The Client agrees to:
- provide accurate, truthful and complete information;
- communicate their actual dates, budget and constraints;
- disclose any particular requirements relevant to planning the trip;
- respond within a period compatible with the agreed schedule;
- read the documents supplied and carry out necessary checks;
- book recommended services sufficiently in advance;
- check prices and availability before making any payment to a third party;
- comply with the terms of third-party suppliers;
- hold all required travel and identity documents;
- verify the official requirements applicable to their circumstances;
- take out any insurance they consider necessary;
- comply with the laws and customs of the countries visited.
The Client remains solely responsible for:
- their booking decisions;
- their expenditure and budget;
- their passports, visas and travel documents;
- their insurance;
- compliance with health and administrative requirements;
- their conduct during the trip.
Voyager Mieux shall not be responsible for consequences arising from inaccurate, incomplete or late information supplied by the Client.
Article 10 Revisions and changes
10.1. Included revisions
The number of revisions, corrections or discussions included is stated in the offer, quotation or order confirmation.
Where an offer includes a review within a specified period, the Client must submit their comments within that period.
10.2. Substantial changes to the project
The following requests may constitute a new service or result in an additional charge:
- a change of destination;
- a significant change to the travel dates or duration;
- the addition of travellers or new destinations;
- a substantial change to the budget;
- a complete change to the desired pace or expectations;
- reconstruction of an itinerary that has already been completed;
- a request exceeding the number of included revisions.
Voyager Mieux will inform the Client before carrying out any additional paid work.
Article 11 Right of withdrawal
11.1. General principle
Where the Client acts as a Consumer and concludes a distance contract, the Client is generally entitled to withdraw from the contract within fourteen days from the date on which it was concluded, without having to provide a reason.
Notice of withdrawal may be sent to: contact@voyager-mieux.com , using the form at the end of these Terms or by any other unambiguous statement.
11.2. Early commencement of a service
Where the Client wishes Voyager Mieux to begin performing a service before the end of the fourteen-day withdrawal period, the Client must make an express request.
If the Client subsequently withdraws after the requested commencement but before the service has been fully performed, the Client remains liable for an amount proportionate to the work carried out up to the date on which the withdrawal decision is communicated.
Where the service has been fully performed before the end of the withdrawal period, the right of withdrawal is lost where performance began following:
- the Client’s prior express consent;
- the Client’s request for immediate performance;
- the Client’s acknowledgement that the right of withdrawal will be lost once the service has been fully performed.
11.3. Digital content supplied immediately
For digital content supplied without a physical medium, including a preset, ebook, guide or downloadable file, access may be provided immediately after payment.
The Client loses the right of withdrawal where supply begins after:
- the Client has given prior express consent to immediate supply;
- the Client has expressly acknowledged the loss of the right of withdrawal;
- Voyager Mieux has confirmed that consent on a durable medium.
Where these conditions have not been validly satisfied, the Consumer’s statutory rights remain applicable.
11.4. Refund
Where the right of withdrawal is validly exercised, Voyager Mieux will refund any amount due within the statutory period, using the same payment method used for the original transaction unless the Client has expressly agreed otherwise.
Article 12 Cancellation, suspension and termination
12.1. Cancellation after the withdrawal period
Once the statutory withdrawal period has expired, a request to cancel does not automatically entitle the Client to a refund for work that has already begun or been completed.
Depending on the progress of the project, Voyager Mieux will determine:
- the amount corresponding to work already performed;
- any costs incurred that cannot be recovered;
- the part of the price relating to work that will not be performed.
Any amount that is no longer payable may be refunded where applicable, without prejudice to the mandatory rights of the Consumer.
12.2. Digital products already supplied
A digital product already supplied following a valid waiver of the right of withdrawal is not refundable solely because the Client has changed their mind.
This does not restrict the statutory guarantee of conformity or any other mandatory Consumer right.
12.3. Failure by the Client to respond
Where the Client fails to respond despite a reminder, Voyager Mieux may suspend performance of the service.
After thirty days without a response, recommencement will depend on Voyager Mieux’s availability. Work already completed remains payable.
12.4. Serious breach
Voyager Mieux may suspend or terminate the service in the event of:
- non-payment of an amount due;
- persistent refusal to provide essential information;
- an unlawful request;
- fraud or attempted fraud;
- insulting, threatening or abusive conduct.
The Client will be informed of the suspension or termination and of the applicable financial calculation.
Article 13 Conditions applying to digital products
13.1. Access and downloading
A download link may be sent automatically or manually after payment has been confirmed.
The Client must download and save the files within a reasonable period.
Voyager Mieux does not guarantee permanent access to an expired download link, without prejudice to the applicable statutory guarantees.
13.2. Compatibility
File formats, compatible software, recommended versions, technical requirements and available instructions are specified on the product page or in the product documentation.
The Client must check the compatibility of their device and software before placing an order.
13.3. Lightroom presets
The result obtained from a preset may vary depending on:
- the original photograph;
- exposure and white balance;
- the camera and lens used;
- the colour profile;
- lighting and shooting conditions;
- the software version;
- any additional adjustments made by the Client.
A normal variation in the visual result does not constitute a defect where the file corresponds to its description and works with the advertised software and formats.
13.4. Version and updates
Ebooks, guides, presets and static files are supplied in the version available on the date of the order.
Unless otherwise stated on the product page, no subscription, permanent hosting or regular updates are included.
Updates required to maintain conformity will be provided where required by law and depending on the nature of the product concerned.
13.5. Support
The Client may report a defective link, corrupted file or technical problem to: contact@voyager-mieux.com .
Article 14 Intellectual property
Content created or sold by Voyager Mieux is protected by intellectual property laws, including:
- travel itineraries and travel books;
- texts, descriptions, selections and document structures;
- maps and location lists;
- ebooks, guides and practical resources;
- presets and digital files;
- photographs, graphics, logos and brand elements.
The order grants the Client a personal, non-exclusive and non-transferable right of use.
14.1. Personal use
A personalised itinerary or guide may be used by the Client and the people participating in the same travel project.
Ebooks, guides and other digital documents may not be publicly distributed, reproduced in quantity, resold or made available to third parties.
14.2. Use of presets
The Client may use purchased presets to edit their own photographs, including as part of a professional activity.
The Client may not:
- resell or redistribute the preset files;
- share them free of charge with third parties;
- publish them on a download platform;
- include them in another pack intended for sale or distribution;
- claim to have created the preset files themselves.
No intellectual property rights are transferred to the Client.
Article 15 Statutory guarantees applying to digital content

Statutory guarantee of conformity
The Consumer is entitled to rely on the statutory guarantee of conformity where a lack of conformity appears within two years from the one-off supply of digital content or a digital service.
During this period, the Consumer is only required to establish the existence of the lack of conformity and not the date on which it first appeared.
The statutory guarantee of conformity entitles the Consumer to have the digital content or digital service brought into conformity without undue delay, free of charge and without significant inconvenience.
The Consumer may obtain a reduction in price while retaining the digital content or service, or terminate the contract and obtain a refund in exchange for ceasing to use the content or service, particularly where:
- Voyager Mieux refuses to bring the digital content or service into conformity;
- conformity is delayed without justification;
- conformity cannot be achieved without cost to the Consumer;
- conformity would cause significant inconvenience to the Consumer;
- the lack of conformity persists after an attempt to correct it.
The Consumer may also request an immediate price reduction or termination of the contract where the lack of conformity is sufficiently serious.
Any period during which the digital content or digital service is unavailable for the purpose of bringing it into conformity suspends the remaining guarantee period until conforming supply resumes.
These rights arise in particular under Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.
Guarantee against hidden defects
The Consumer also benefits from the guarantee against hidden defects provided by Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect.
This guarantee may entitle the Consumer to a reduction in price where the content is retained, or a refund in exchange for ceasing to use the digital content or service.
Nothing in these Terms limits or excludes a mandatory statutory guarantee.
Article 16 Liability
16.1. Performance of the service
Voyager Mieux performs its services with reasonable care and diligence, based on:
- the requirements expressed by the Client;
- the information supplied by the Client;
- the information available when the research is carried out;
- Voyager Mieux’s experience and knowledge.
Voyager Mieux is required to perform the agreed service but does not guarantee that every recommendation will correspond to the Client’s subjective tastes or that the trip will be unaffected by external events.
16.2. Changes to information
Availability, prices, timetables, access conditions, formalities, events, construction work, closures and cancellation conditions may change after delivery of the itinerary.
The Client must verify essential information directly with official sources and relevant suppliers before making a booking and before travelling.
16.3. Third-party suppliers
Voyager Mieux is not responsible for the performance of contracts concluded directly between the Client and third-party suppliers.
This includes, in particular:
- cancelled or modified flights, trains or other transport;
- errors, closures or unavailable accommodation;
- the actual quality of a restaurant or activity;
- accidents, delays, strikes or disruption;
- changes in prices or booking conditions;
- decisions made by authorities or local suppliers.
Any complaint relating to a third-party booking must be addressed to the supplier concerned.
16.4. Administrative and health requirements
Information concerning passports, visas, vaccinations, insurance, customs, health requirements and entry rules is provided for information purposes only.
The Client must verify these requirements with the relevant official authorities according to their nationality, country of residence, health and personal circumstances.
16.5. Statutory limitations
Voyager Mieux shall not be liable for any loss directly resulting from:
- an act or decision of the Client;
- inaccurate or incomplete information supplied by the Client;
- failure to comply with an official requirement;
- an act or omission of a third-party supplier;
- an external event that is unforeseeable and unavoidable.
No limitation applies where prohibited by mandatory law, particularly in cases involving personal injury, gross negligence or intentional misconduct.
Article 17 Force majeure
Neither party shall be liable for a delay or failure to perform caused by an event recognised as force majeure under French law.
Subject to the applicable legal requirements, such events may include:
- a natural disaster;
- a major fire or technical failure;
- war, civil disorder or a terrorist attack;
- an epidemic or administrative closure;
- a widespread interruption of communication systems;
- a serious, sudden and unforeseeable incapacity personally preventing performance.
Performance is suspended for the duration of the impediment.
Where the impediment becomes permanent or continues for so long that the contract no longer serves its purpose, the contract may be terminated in accordance with applicable law.
Article 18 Personal data
Personal data collected may be used to:
- process enquiries and orders;
- communicate with the Client;
- personalise and perform the services;
- deliver purchased products;
- manage payments and invoices;
- comply with legal and accounting obligations.
Full information about the processing of personal data is available in the privacy policy published on voyager-mieux.com.
Any request concerning personal data may be sent to: contact@voyager-mieux.com .
Article 19 Complaints and consumer mediation
19.1. Prior complaint
In the event of a problem, the Client must first send a written complaint to Voyager Mieux.
By email: contact@voyager-mieux.com
By post:
Voyager Mieux – Merabet Hichem, sole proprietor
11 rue du Général-de-Gaulle
68800 Thann – France
The complaint must include the Client’s contact details, order or quotation number, the relevant circumstances and the requested solution.
19.2. Consumer mediation
Where a prior written complaint has not resulted in an amicable solution, the Consumer may refer the dispute free of charge to the consumer mediator appointed by Voyager Mieux.
Address: [POSTAL ADDRESS OF THE MEDIATOR]
Website: [WEBSITE OF THE MEDIATOR]
A mediation request must satisfy the admissibility requirements established by law and by the appointed mediator.
Article 20 Evidence, communications and record keeping
Emails, quotations, confirmations, invoices, order data and payment system records may be used as evidence of communications and transactions between the parties.
The Client should retain:
- the quotation or order summary;
- the order confirmation;
- these Terms;
- confirmations relating to the right of withdrawal;
- the invoice;
- delivery documents and download links.
Contractual documents are sent by email or through another medium that allows them to be stored and reproduced.
The Client agrees that communications relating to the order may be sent electronically, unless otherwise required by law.
Article 21 Professional clients
Where a Client places an order in the course of a professional activity, provisions exclusively applicable to consumers, including those relating to the right of withdrawal and consumer mediation, apply only where expressly required by law.
Specific conditions may be included in a quotation issued to a professional Client. In the event of a conflict, those specific conditions shall prevail for the relevant order.
21.1. Late payment by a professional Client
In the event of late payment, penalties calculated at three times the French statutory interest rate shall become payable from the day following the payment date shown on the invoice, without any reminder being required.
A fixed recovery charge of €40 shall also automatically become payable by the professional Client.
Where the recovery costs actually incurred exceed this fixed charge, Voyager Mieux may claim additional compensation upon providing supporting evidence.
Article 22 Applicable law and dispute resolution
These Terms and all contracts concluded with Voyager Mieux are governed by French law.
Where a Consumer resides in another country, this choice of law does not deprive the Consumer of the protection afforded by mandatory provisions applicable in their country of residence.
The parties will attempt to resolve any dispute amicably before commencing court proceedings.
Where no amicable solution or mediation can be reached, the dispute may be brought before the court having jurisdiction under the applicable legal rules.
If any provision of these Terms is declared invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
A failure to exercise a right immediately does not constitute a waiver of that right.
Article 23 Model withdrawal form
This form should only be used where the statutory right of withdrawal applies.
It may be copied and sent to: contact@voyager-mieux.com .
